By creating a Rygiene account or using the Rygiene app, you agree to these Terms of Service and to our Privacy Policy. If you don't agree, don't use Rygiene. These Terms are a binding agreement between you and Rygiene LLC.
You must be at least 18 years old and the parent or legal guardian of any child whose riding you monitor with Rygiene. By adding a child rider, you represent that you are that child's parent or guardian and that you have the authority to consent to the collection of their information as described in the Privacy Policy. The child's device runs in a passive "Rider" mode; children do not create accounts.
Rygiene is an informational coaching and awareness tool that records a child's e-bike/bicycle rides, flags noteworthy moments, and sends the parent alerts. It is designed to support your judgment and start conversations — not to replace them. Please read Section 4 carefully; these limits are fundamental to the service.
Rygiene is an informational and coaching tool intended to assist parents and guardians. It is not a substitute for active parental supervision, in-person safety instruction, or your own judgment about whether, where, and when your child should ride. You remain solely responsible for your child's safety and conduct. Rygiene does not control your child's behavior and cannot prevent unsafe riding, accidents, or injury.
Rygiene is not an emergency response, medical, or safety-monitoring service and does not contact emergency responders. Notifications are delivered on a best-effort basis and may be delayed or undelivered due to factors outside our control (device, network, battery, or operating-system conditions). Never rely on Rygiene in an emergency. If your child is in danger or injured, call 911 or your local emergency number immediately.
Location and motion data are derived from the GPS and sensors in your child's device and from third-party map data. This information may be inaccurate, incomplete, delayed, or temporarily unavailable. Distances, speeds, routes, and locations shown are estimates and should not be treated as precise or authoritative. Rygiene must not be used as the sole means of determining your child's location.
Rygiene detects, classifies, and flags rides using sensor data and algorithms that are probabilistic by nature. It may fail to detect a ride, detect a ride that did not occur, misclassify a trip, raise a flag that does not reflect what actually happened, or fail to raise one that should have appeared. Flags (and any related summary or estimate) are intended to support parental judgment — they are not guarantees, certifications, or determinations of fact. We do not warrant the accuracy, completeness, or reliability of any detection, classification, flag, or alert.
You understand that riding an e-bike, bicycle, scooter, or similar vehicle is an inherently dangerous activity that can result in serious injury, permanent disability, or death, and that these risks exist whether or not you use Rygiene. Road, traffic, weather, equipment, and rider-behavior hazards are outside Rygiene's knowledge and control. Rygiene does not control, supervise, instruct, or physically affect any ride, rider, or vehicle, and does not detect, prevent, or reduce the risk of any accident, collision, injury, or death. As the parent or guardian, you are solely responsible for deciding whether, when, where, and how your child rides, for your child's equipment and protective gear, and for supervising your child. By using Rygiene, you knowingly and voluntarily assume all risks arising from your child's riding — whether or not Rygiene recorded, flagged, detected, or alerted on a given ride, and whether or not any flag, alert, or location was accurate, timely, delivered, or received.
Local, state, and federal laws govern where, how, and by whom e-bikes, bicycles, scooters, and similar vehicles may be ridden — including rules on e-bike class and equipment, minimum rider age, helmet use, registration or licensing, and whether riding is permitted on a given road, sidewalk, bike lane, or path. These laws vary by location and change over time. You are solely responsible for knowing and complying with all laws that apply to your child's riding, and those laws control over anything Rygiene shows or permits. Rygiene does not provide legal advice and does not determine, verify, or ensure that any ride is lawful. Any speed limits, zones, thresholds, flags, and alerts in Rygiene are coaching estimates set by you or by us for awareness — they are not statements of the legal speed limit, the legal riding area, or any other legal requirement, and an unflagged ride or the absence of an alert does not mean a ride was lawful or safe.
You're responsible for keeping your login credentials secure and for activity under your account. Provide accurate information, and let us know at support@rygiene.app if you suspect unauthorized use. You're responsible for the devices you pair and for informing members of your household, as appropriate, about how Rygiene works.
You agree to use Rygiene only for its intended, lawful purpose — a parent understanding their own child's riding. You will not: use Rygiene to track or surveil anyone other than your own minor child; misuse, reverse engineer, disrupt, or attempt to gain unauthorized access to the service; or use it in violation of any law. We may suspend or terminate accounts that misuse the service.
Rygiene and its content (excluding your data) are owned by Rygiene LLC and protected by law. You may not copy, modify, or create derivative works except as the app normally allows. You retain your own data; you grant us the limited rights needed to operate the service for you (e.g., storing and processing rides to flag them and send your alerts).
Rygiene is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, timely, secure, or error-free, or that any alert, flag, or location will be accurate or delivered.
To the maximum extent permitted by law, Rygiene and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, injury, or harm arising out of or relating to your use of (or inability to use) the service, the accuracy or delivery of any notification, flag, or location, or any act or omission of a user. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the service will not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) fifty U.S. dollars ($50). Some jurisdictions do not allow certain of these limitations, so some of these limitations may not apply to you.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for (a) gross negligence, (b) willful misconduct or fraud, or (c) death or personal injury to the extent such a limitation is prohibited by law. The limitations and exclusions in Sections 4, 9, and 10 apply to the fullest extent permitted by applicable law; if any portion is held unenforceable, it will be reduced to the minimum extent necessary and the remainder will remain in full force.
To the extent permitted by law, you agree to indemnify and hold harmless Rygiene LLC from claims arising out of your misuse of the service, your violation of these Terms, or your violation of any law or the rights of a third party.
You may stop using Rygiene and delete your account at any time (Settings → Delete account). We may suspend or terminate access for violation of these Terms or to protect the service or its users. Sections that by their nature should survive (e.g., §§4, 9, 10, 11, 13) survive termination.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. The state and federal courts located in Florida will have jurisdiction over any dispute not otherwise resolved.
We may update these Terms. Material changes will be communicated in-app and by email and take effect on the stated date. Continued use after changes means you accept the updated Terms.
